I am not a lawyer or police but my understanding is that it is fraud to ask people for money for one thing and use it for another, and it can be prosecuted as such.

Somebody else may know more.

I think that is indeed fraud.

Unfortunately, even when the culprit is actually convicted, the money is often not recoverable. sf-frown That $50 million Earl Jones affair in Montreal comes to mind:
